A mother from Durrës denounces a dramatic situation, she has not been able to see her 2-year-old son for more than 9 months, who according to her is being held by her former partner, a person who is not legally the child's father.
Tearfully, she reveals that she separated from her ex-partner due to alcohol consumption, violence and constant insults. After the separation, she kept her 1-year-old daughter, while her 2-year-old son was taken by her ex-partner.
"I haven't seen my son since September. I miss him, I'm dying," she says.
According to her, the child lives in difficult conditions, as the mother of the former cohabitant is disabled, while he himself constantly consumes alcohol. Meanwhile, the child results without legally recognized paternity, as the mother had not completed a year from the previous divorce at the time of the birth.
The complainant says she has contacted the police and social services, but has not received any concrete solutions.
"I went to the police, they told me 'there's nothing we can do'. Even social services just wait for me with appointments ," she says.
During the confrontation with the former cohabitant, the latter refuses to hand over the child, stating that he has opened a legal process for the recognition of paternity.
"I'm not giving up the child. Let the court process end ," he says.
But according to sources, the current court process is only related to the recognition of paternity and not to the custody of the child, which requires a special legal procedure. Until the end of this process, he has no legal status as a parent. The father justifies his action by saying that "we made this agreement at the police verbally without signing a document, she will keep the daughter and I will keep the son."
Social workers have demanded that the child be returned to his mother and have warned that keeping him in these conditions could constitute a legal violation. They have even suggested that the case could be treated as hostage-taking.
However, when the mother approached the police again, she claims she was met with rejection and inappropriate communication.
"File the report in court. Don't call me again, get out," she was told by a police officer, according to her.
