Manastirliu in the race for Tirana/ Kristaq Kume: Here's who will take her mandate

The "hot" topic of today's Socialist Party National Assembly was the fact that Tirana will be entering by-elections this season, and this is because Erion Veliaj is in detention following investigations by the Special Prosecution Office.
Rama, during his speech in the Assembly, proposed Ogerta Manastirliu as the Socialist Party's candidate for mayor of Tirana. This proposal was clearly unexpected for Manastirliu, as the fate of the capital was not known with certainty whether it would be included in early elections or not.
But what happens to the mandate of the Manastirliu MP? The former chairman of the Central Election Commission, Kristaq Kume, was invited to the "Përballë Lajmit" column on Klan News, from where he analyzed the legal aspect of the Manastirliu mandate.
Kume stated that based on the Electoral Code, it is up to the candidate of the less represented gender to take the mandate. Considering the situation that there are ten women and nine men, it is up to the latter to have one MP. Thus, Kume states that it is up to Xhemal Qefalia.
"The Electoral Code, on this issue, refers to the least represented gender. The least represented gender in our country is the female gender. In this specific case, we are in a situation that is not so simple and clear. Why? We currently have a total of ten female deputies, ten women and nine men. A woman resigns. With this situation that we have today, the least represented gender is men. They have one less, they are less represented. Which means, if we are to read word for word what the provision that deals with the problem of vacancy crime says, which is different from what we have discussed here how to act for open lists, for closed lists, if we take the case of the DP candidate for Durrës, in those provisions it is mentioned about the least represented gender. Currently, the least represented gender is men. So, which means that whoever is first on the list of substitutes, of those waiting in line, will get it. And the first "Who is it? It's a man. There's no need to remove it and say no, because for the sake of gender representation we should put a woman. Or not? One of the ways of reasoning. So, the first one takes it. The first one is a man, Mr. Qefalia, don't get me wrong," said Kume.
The former head of the CEC also gave a second scenario for the selection of a legal representative in place of Manastirliu. According to Kume, it could be a woman, in this case Blerina Gjylameti, based on the interpretation of the lower representation of women in the Parliament.
"In another scenario, then, for the sake of the general attitude towards this moment, which is not the least represented gender, in general, it could be interpreted as saying let it go, a woman lets it go, a woman lets it go. It's up to Gjylameti to take it," he said.
But who is in charge of this interpretation? Kume explains that it all remains in the hands of Ilirjan Celibashi, the head of the CEC. For Kume, Celibashi will choose Qefalia, but according to him, it could happen that Gjylameti will seek the mandate based on the fact that women do not even make up 30% of the Assembly.
"It's not that easy. Mr. Celibashi will make this interpretation. For me, Mr. Celibashi has to give it to Qefalia, because he says we are in these conditions. After that, Gjylameti may come out and say that this other thing can also be interpreted that out of 140 deputies, there are so many women and so many men, not even 30% are women... and it could be... But, for me, the cold reading, without emotion, would be Mr. Qefalia", said Kume.
We recall that Prime Minister Edi Rama, through the sentence "Ogerta Manastirliu is the person that Tirana needs today," proposed the socialist's name for the Tirana Municipality candidacy.
"The citizens of Tirana cannot wait another seven days without knowing what will happen to the Municipality of Tirana. I appreciate her for the closeness of working with her, or from a distance, but always with respect and integrity in carrying out every task, and above all for the special service to the public, the care of her collaborators and the attention to every person in Albania who has been assigned to her duties, that Ogerta Manastirliu is the person that Tirana needs today," Rama continued.
Thus, after Rama proposed Manastirli, he requested from the Municipal Council to initiate procedures for the dismissal of the current mayor, Erion Veliaj, who has been in prison since February of this year.
