Favoring construction without permits, causing millions of lek in damage to the state through tax evasion, the Tirana Prosecution Office sends the former director of ASHK, Elira Gogo, to trial
The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, completed the investigations and sent to trial citizen EG, former director of the State Cadastre Agency (ASHK) Tirana, accused of 'Forgery of documents' and 'Abuse of office', provided for by articles 190/3 and 248 of the Criminal Code, as well as citizen Sh.B. accused of 'Illegal construction' and 'Fraud' provided for by articles 119/a/2 and 143/3 of the Criminal Code.
In the framework of criminal proceedings no. 8699, registered on the basis of the complaints made, the investigations of the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, confirmed that on 'Bogdanëve' Street there were constructions with a change of destination in violation of the granted permit. The area built outside the permit determined by the technical expertise act is 2240 m². For this area, the infrastructure impact tax was calculated in the amount of 24,998,400 lekë, much higher than the one paid on the basis of falsified documents.
The investigations revealed that the actions of citizen EG, in her capacity as Director of the Tirana North ASHK, included compiling and signing documents without conducting field measurements, reporting areas much smaller than the actual ones. These actions have brought unfair benefit to the construction entity and harm to the public interest.
From the above, it was proven that the elements of the criminal offense of "forgery of seals, stamps or forms" provided for by Article 190/3 of the Criminal Code were consumed by citizen EG, since without making measurements on the ground she ordered the payment of the infrastructure tax and according to her, the total area of the additional object that would be legalized is 80.5 m2. While from the expert report the area of the construction outside the construction permit is 2240 m2. As well as the criminal offense of 'Abuse of office' provided for by Article 248 of the Criminal Code was consumed.
Meanwhile, the U.S. citizen has committed elements of the criminal offense "Illegal construction" provided for by article 199/a/3 in the context of violating the construction permit for profit.
