They did not exercise their duty to control the territory in at least 31 cases, the Fier Prosecutor's Office sends the chief inspector and 2 inspectors of the Divjaka IMT to court for 'Abuse of duty'
The Prosecutor's Office at the First Instance Court of General Jurisdiction in Fier completed the investigations and sent the chief inspector and two inspectors of the Territory Protection Inspectorate (IMT) in Divjakë to trial, for the criminal offense of 'Abuse of office' provided for by Article 248 of the Criminal Code.
At the conclusion of the investigations into criminal proceedings no. 346, it was proven that in 31 cases investigated by the prosecution and sent for trial for the criminal offense of "Illegal construction", provided for by Article 199/ai of the Criminal Code, and convicted by the court with final decisions, the officials of the Local Inspectorate for Territorial Protection, at the Municipality of Divjaka, did not exercise their legal responsibilities for controlling the territory, as their functional duty.
It also resulted that even in cases of ascertaining administrative violations of unauthorized construction, the regular legal procedure was not followed, according to the provisions of the law, such as ascertainment, imposition of a fine, demolition of the building, and criminal reporting.
It also turned out that no action was taken to collect administrative measures, exceeding the statute of limitations, which has caused real damage to the state budget. The investigation proved that the economic damage to the state and local unit budgets from the non-collection of fines for the period 2021–2022 is in the amount of 11,170,000 (eleven million one hundred and seventy thousand) Lek.
In conclusion, the Prosecutor's Office at the First Instance Court of General Jurisdiction, Fier sent the case for trial against the defendants:
– RL – Chief Inspector of the Local Inspectorate of Territorial Protection at the Municipality of Divjaka, accused of the criminal offense of “Abuse of office”, provided for by Article 248 of the Criminal Code.
– SM – Inspector at the Local Inspectorate of Territorial Protection at the Municipality of Divjaka, accused of the criminal offense of “Abuse of office”, provided for by Article 248 of the Criminal Code.
– IK – Inspector and former chief inspector at the Local Inspectorate of Territorial Protection at the Municipality of Divjaka, accused of the criminal offense of “Abuse of office”, provided for by Article 248 of the Criminal Code.
