Lawyer Ermal Hamataj commented on the stabbing murder of Egli Pashollari, saying that we are dealing with a murder in self-defense, which according to him has crossed the limits.
Hamataj said that the murder occurred in conditions of momentary shock, as according to him, no one went there to commit the serious crime.
" I don't think it's intentional murder, for me it's in terms of self-defense, but by overcoming the elements of self-defense. The law has provided for it in this form, to do an action in terms of strong psychological shock. We are human beings who set certain limits within our habitat and these limits are not protected by the law, but by our ego. The ego says that the family member is not affected. The ego says that if the family member is affected, you will react. Then here our ego conflicts with the law, because many actions that are done because of the ego end up violating the law and committing a criminal offense," he said.
The lawyer further said that when a family member is affected, the human instinct is to react, regardless of the harm it may cause.
"What happened there, even in the most civilized world, I am sure that under the conditions of a momentary shock, it could have happened, because I don't see anyone who set out to kill someone, but I see a conflict that has degenerated into fists and perhaps the use of cold weapons, because a person who wants to kill you doesn't rush behind the car to say stop, because there are other ways of committing murder, but it is simply an individual's instinct to protect that protective barrier that is mine.
"We need to talk about how we grew up, the environment in which we grew up and what characterizes us. So, Balkans are sanguine types, it is one of these classifications that make good or bad decisions in a split second and this has nothing to do with the fact that we are bad people, it has to do with the fact that we grew up," he stated on Euronews Albania.
The serious incident occurred on the afternoon of February 20, at around 3:40 p.m. Young Egli Pashollari, who was said to have been one of Emiljano Shullazi's close associates, was stabbed in the back and unfortunately died on the way to the hospital.
In connection with this incident, the police have declared citizen Gazment Buçpapa wanted, while the latter's wife has also given testimony to the police.
Initially, she stated that the 31-year-old had harassed her and therefore told her husband, who then stabbed the young man. But this statement was refuted just a few hours later, when she was the one who said that the "apple of contention" became the roadblock.
