Berisha's ''Non Grata'', DASH reacts: Some exceptions

The US State Department has clarified for Top Channel the statement of the leader of the Democratic Party, Sali Berisha, that he has been removed from non grata status.

In an email response, it is stated that the State Department has made exceptions to some of the provisions of Article 7031 on which the non grata of five years ago was based.

"The Department of State has issued waivers for certain provisions under Section 7031(c), imposed by the previous administration, because granting these waivers serves a compelling national interest of the United States," a State Department spokesperson told Top Channel.

According to the definitions of the DASH, waiver means an exception from the application of a measure or restriction, granted by the authority that imposed it.

In the case of the US State Department, a waiver does not necessarily mean that the original decision has been overturned. It means that, for certain reasons (often related to the national interest of the US), the person or entity benefits from an exemption from the consequences of that decision.

For determinations under section 7031(c), which typically relate to allegations of significant corruption or serious human rights violations and result in a ban on entry into the United States for the person and their family, a waiver may mean that:

the travel restriction does not apply in a given case;

the person is allowed to enter the US for specific reasons;
