5 members voted against, Constitutional Court decision that left Meta in prison

The April 8 decision for the President of the Freedom Party, Ilir Meta, has been made public, with which the Constitutional Court of Albania rejected the request to repeal the security measure "prison arrest".

According to the published decision, five members of the Constitutional Court voted against Meta's claims, leaving the security measure against the leader of the Freedom Party in force.

Meanwhile, judges Marjana Semini and Marsida Xhaferllari voted in favor of accepting the request, while judge Sonila Bejtja submitted a separate opinion, partially supporting Meta's arguments.

The two judges who voted against the majority decision, Xhaferllari and Semini, argue that Meta's claim of violating Article 25 of the Constitution, which prohibits torture and inhuman, cruel, or degrading treatment, was well-founded.

In their opinion, there were sufficient elements to establish a possible violation of fundamental rights during the arrest of the former president.

In its reasoning, the Court assesses that there is sufficient data and evidence that supports reasonable suspicion of the criminal offenses for which Meta is being investigated.

The Constitutional Court also rejected the claim that the security measure was unjustified or disproportionate, arguing that the ordinary courts had respected the legal criteria in imposing it.

Regarding the manner of Meta's arrest in October 2024, which he described as humiliating and inhumane, the Constitutional Court did not rule on the merits of the case.

According to her, this claim cannot be examined at this stage, as it remains the subject of investigation by the competent authorities following the report filed by Meta himself at the Tirana Prosecutor's Office.
