Vlora Airport in a bind, Xama: The state risks paying at least 117 million euros

Journalist Ola Xama, invited to MCN TV, spoke about the conflict between shareholders of the Vlora airport, which is preventing its operation.

According to her, there is a lawsuit and counter-suit between Mabco and 2A Group for 47% of the shares, a matter that is also being investigated by the Tirana Prosecutor's Office. The Court of Appeal has suspended the voting rights for this percentage, complicating the situation.

Xama warned that government intervention could lead to arbitration, costing the state at least 117 million euros, while the construction of the airport would cost 87 million euros. According to her, the contract was drafted carelessly and the airport is not expected to open in March.

Xama: Mabco has filed a lawsuit in the civil court requesting the annulment of several assembly decisions, with an administrator whom Mr. Pacolli accused of working for the other party. There is a countersuit from 2A Group. The vote for the alienation of the company's shares has been blocked. 2A Group claims that Pacolli sold 47% of the shares. Pacolli says it is not true. That is why they are at the Tirana Prosecutor's Office. The Court of Appeal says that Mabco's vote for 47% of the shares is suspended, but it operates with 51% of the shares. Mabco has called an assembly and requested a change in the statute, to change the alienation of the shares. A countersuit has been filed by Valon Ademi. So it is all a real mess.

A day ago, Mabco held a conference with its representatives, where it called the situation an expropriation, meaning that the state is taking something by force. It doesn't matter if the government does it, but the court can do it too. This could pave the way for the rights that the company can claim for the investments and the missing profit in arbitration. The accusations between the partners continue. It doesn't seem like the airport will be put into operation by March. 

How do I see it from the perspective of an independent person? If the government, the contracting authority, intervened, it would bring water to the source of arbitration. It would give both companies the right. Without prejudice to anyone, we have a conflict between two businessmen that arose out of nowhere and this could even be framed as a conflict, it is a percentage of possibility, as could other scenarios. If the state unilaterally terminates the contract, the contract obliges it to pay 56 million euros in loans, plus interest and the value of the investment. The value of the investment that the companies claim is approximately 140 million euros.

The minimum amount that the state can pay is 117 million euros. Meanwhile, the construction of the airport would cost 87 million euros. These are contracts made carelessly.
