It was February 2010, when Florjan Kola, then 25 years old, had a car accident while returning from Tirana to Shkodër. After several months of treatment in the hospital and then at home, the young man receives a phone call that would change his life for the better. At least that's what he thought.
"He told me I am lawyer Genci Ismaili, the court appointed me and I am your lawyer. We will receive a reward. He asked me for a percentage, of course I left him 30% of the amount", says Florjani.
The judicial process started, accompanied by the special power of attorney, signed by Florjani himself, which would give lawyer Genci Ismaili the legal right to represent him in any legal action related to the case in question. But in addition to the first power of attorney, a second one was also attached to the documents, signed on July 8, 2011, where Florjani's mother and his two sisters also gave the legal right to the same lawyer to represent them in the trial against to the insurance company, in order to obtain compensation, pecuniary and non-pecuniary. However, this document has a big problem, since as Florjani testifies, his family members were not aware of the trial and the signatures, since Florjani had also signed for his mother and two sisters, with the sole purpose of gaining money. But things did not go according to the young man's predictions. After many procedures, the lawyer told Florjani that they could not get any money.
"We will open a trial for the camp, you will receive money. He didn't open a court case for the camp, nor did we get any money, and he refused to give any explanation", says the 39-year-old from Shkodran.
He believed every word of the lawyer, until the moment he opened his file in the archive.
"There I discovered the amounts of the expert, the power of attorney, I discovered the dismissal of the case. That employee told me that the lawyer dropped the case and with that case you lost 25 million. The court had compensated me, but without me knowing that it compensated me".
The truth was very bitter for Florjani, this is because the Court of Tirana had decided to compensate him with 25 million lek, according to the expert's assessment, an obligation that would be paid by the insurance company, but on February 27, 2013, judge Manjola Bejleri decided the dismissal of the case, as the lawyer Genci Ismaili had avoided the court session by not appearing in the courtroom at all.
"The lawyer had made an agreement with Sigal. I have the document that I transferred 27 million to the lawyer in his account. The powers of attorney were made without my knowledge, without the knowledge of family members. When I saw the powers of attorney, the signatures were mine. The lawyer had taken advantage of the opportunity and offered me the powers of attorney before I signed the power of attorney on behalf of someone else," he says.
All the claims and accusations of Florjani are only one side of the coin, that's why we estimated that it is right to listen to the claims of lawyer Ismail as well. Initially being removed as a relative of the victim. As soon as we go to the lawyer's office, he throws us out with force and threatening phrases, then leaves on his bicycle. We went again for a meeting with lawyer Ismail, but the second time he pedaled away.
