IPARD funds in court, 76 beneficiaries facing return of grants

Since 2023, the IPARD agricultural financing program in Albania has been under investigation for suspected abuse of funds, which led to the suspension of the scheme and the launch of verifications by Albanian and European authorities.
"76 entities are in legal proceedings for the return of the amount (total/partial, as the case may be, found to be in violation of the terms of the contract)," states the official response of the Agency for Agricultural and Rural Development (AZHBR).
Within the framework of the IPARD II Program, by 2023, AZHBR had opened 8 legal proceedings for the return of the amount received from entities that received prepayments for the implementation of the investment, while at the end of 2025 this figure increased to 76.
The institutions confirm that from the program to the object of the investigation, the findings of the process have been included in an official report sent to the authorities.
"The Final Investigation Report (Abstract) has been submitted to the Albanian Authorities and is classified as 'strictly confidential'," the AZHBR response states.
The case remains in the preliminary investigation phase and due to investigative secrecy, justice authorities are not making public details of its actions or results.
"Investigative actions carried out in the preliminary investigation phase constitute an investigative secret," states an official response from the Special Structure Against Corruption and Organized Crime (SPAK).
Meanwhile, the institutions responsible for implementing the program provide another overview of developments related to IPARD funds, but without making public who are the entities facing processes for the return of these funds, even though the lists of beneficiaries have been public.
"Making available the list of subjects that are in judicial proceedings cannot be done in accordance with Law No. 119/2014 'On the Right to Information'", states the AZHBR's response.
The Ministry of Agriculture and Rural Development has also been involved in a process of verifications and audits following investigations launched into the use of IPARD funds. However, the findings of this process are considered confidential.
"The Final Investigation Report (Abstract) has been submitted to the Albanian authorities and is classified as 'strictly confidential'," the Ministry of Agriculture and Rural Development's response states.
Suspicions of abuse of IPARD funds have not only been raised after the launch of investigations in 2023. Amfora has identified cases of beneficiaries linked to political figures and businessmen involved in various economic sectors, raising questions about how the program's grants have been distributed.

“Zbatimi i Programit ka vazhduar deri në fund të vitit 2024. Për projektet që kanë respektuar kontratën dhe kriteret e Programit, janë kryer pagesat deri në 31 dhjetor 2024”, thuhet në përgjigjen e AZHBR.
Ndërkohë, institucionet pranojnë se zbatimi i programit IPARD ka pasur mangësi, për të cilat është hartuar një plan veprimi në bashkëpunim me Komisionin Europian me synim adresimin e gjetjeve dhe përmirësimin e administrimit të fondeve.
“Autoritetet shqiptare, strukturat IPARD, kanë ndërmarrë masa të menjëhershme për përmirësimin e administrimit dhe transparencës së programit. Është hartuar një plan veprimi në bashkëpunim me Komisionin Evropian, me synim adresimin e të gjitha rekomandimeve dhe rikthimin e plotë të zbatimit të programit”, shtoi Ministria e Bujqësisë dhe Zhvillimit Rural.
Në të njëjtën përgjigje, ministria theksoi se janë ndërmarrë edhe masa në nivel kombëtar për forcimin e mekanizmave të kontrollit dhe mbrojtjen e interesave financiare të Bashkimit Europian.
“Është miratuar me VKM nr. 275, datë 9.5.2025 ‘Strategjia Kombëtare kundër Mashtrimit 2025-2030’”, shtoi institucioni.
Shqipëria priste në vitin 2023 fazën e tretë të programit, Komisioni Evropian mori një masë ekstreme dhe vendosi pezullimin e përkohshëm të programit të mbështetjes së bujqësisë, bazuar në dyshimet se ka pasur korrupsion në shpërndarjen e granteve, referuar nga Zyra Evropiane Kundër Mashtrimit (OLAF).
Programi IPARD është shoqëruar me debate dhe pikëpyetje mbi mënyrën se si janë shpërndarë grantet dhe mbi transparencën e procesit të përzgjedhjes së projekteve, ndërsa në disa raste përfitues të fondeve janë identifikuar si individë apo kompani me lidhje me politikën ose me ndikim të konsiderueshëm ekonomik.
Këto zhvillime çuan në pezullimin e programit, ndërsa ende nuk ka një afat të qartë se kur pritet të nisë faza e re, në një kohë kur hetimet për përdorimin e fondeve vijojnë.
Ndërkohë, kjo situatë ka shtuar presionin publik për më shumë kontroll dhe transparencë në menaxhimin e fondeve të Bashkimit Europian për sektorin e bujqësisë.
Që nga nisja e zbatimit të programit IPARD në Shqipëri dhe deri në pezullimin e tij, të paktën 510 subjekte kanë përfituar grante për investime në bujqësi dhe zhvillim rural. Vetëm në thirrjen e fundit të programit kanë aplikuar 132 subjekte, ndërsa deri në këtë fazë të hetimeve 76 subjekte janë në procese për kthimin e fondeve dhe hetimet vijojnë.
