Strasbourg condemns Italy: It placed 'Ndrangheta member Giuseppe Morabito under the "biss" regime

The European Court of Human Rights condemns Italy for placing 'Ndrangheta member Giuseppe Morabito under the 41bis regime, despite his health condition.
Known by the nickname "u tiradrittu" (the one who has a good aim), Morabito was the undisputed leader of the 'Africo' mafia clan for years and was arrested after 12 years on the run for mafia activity and drug trafficking.
The Strasbourg Court “is not convinced that the government has credibly demonstrated that, in the particular circumstances of this case, the extended application of the 41bis regime was sufficiently justified,” and condemned the Italian state for violating the article prohibiting inhuman and degrading treatment.
In its decision, the court states that it “does not see how a person affected by an indisputable decline in cognitive abilities – with a diagnosis of Alzheimer’s disease – and who is incapable of understanding his own actions or of following a court hearing, can retain sufficient capacity to maintain or resume – at such an advanced age, after almost 20 years in such a restrictive regime – significant contacts with a criminal organization.
The Strasbourg Court's decision covers the period until May 24, 2023, as on that date, Morabito was hospitalized for an emergency hernia operation and the '41bis' regime was suspended. But lawyer Giovanna Beatrice Araniti, who represented Morabito in the Strasbourg Court, says that 41bis has been reactivated and hopes that today's decision will have an impact on the appeal he has filed with the Court of Cassation to request its suspension.
