The Helsinki Committee, through an official statement, has requested an investigation into the case of police violence against a 14-year-old boy, who on April 12 was escorted to police station no. 1 after being caught throwing objects illegally.

The Helsinki Committee states that the minor's parents claim that police officers had exercised physical and psychological violence against their son.

The Helsinki Committee's observations show that, according to the reviewed documentation, the minor JG, born on 09.11.2010, was escorted to Police Station No. 1 on 12.04.2025 at 18:40. The reason for the escort was suspicion of disturbing the public peace and throwing pyrotechnics. The documentation noted that his parents were notified after the escort.

The Accompanying Report noted that the minor had a hematoma on the side of his right eye. The documentation examined does not show that he had been seen by a doctor. The above fact was denied by the police officers. Although the hematoma was noted in the above-mentioned report, it did not show that the minor had been seen by the Commissariat doctor, contrary to the provisions of Chapter IV of the Standard Procedure “Treatment and security of persons arrested/detained in State Police premises, recording and resolving their requests/complaints”.

At the request of the parents who went to the Police Station immediately after the notification, the Trauma Hospital emergency was notified. The above fact was noted in the relevant register. The minor was accompanied to the Trauma Hospital, on 12.04.2025, at 20:00. According to the accompanying medical epicrisis sent to the AHC by the minor's parents, the diagnosis is: Contusion capitis, punching. To be followed by the family doctor for rest and re-examination according to the referral system.

In the Register of Accompanied Minors, AHC found corrections in the schedules marked in the name of the psychologist and the judicial police officer. In fact, psychologist MT had not met with minor JG at the Police Station, but only at the Trauma Hospital. This shows that the psychologist's name was marked later in the register of the Police Station.

"Considering the above facts, it is concluded that the minor JG was raped, which was evident not only visually, but also in the medical history of the Trauma Hospital. In addition, although the police officers made notes in the register about the hematoma, since they denied the use of violence against him, they did not send him for a visit to the doctor. The minor was taken to the hospital only at the insistence of his parents.

Në rastin e përmendur më lart në Komisariatin e Policisë Nr. 1, të miturit J.G nuk i është dhënë ndihma e nevojshme mjekësore dhe psikologjike duke vepruar kështu në kundërshtim me nenin 34, pika 1, gërma ç dhe pikën 1 të nenit 35 të Kodit të Procedurës Penale, si dhe nenet 10, 14, 18 të Kodit të Drejtësisë Penale për të Mitur, ku bëhet fjalë për parimin e interesit më të lartë të fëmijës, asistencën e psikologut si dhe përdorimin e masave alternative të shmangies. Ndërkohë që prindërit e shtetasit të mitur, më datë 13.04.2025 kanë depozituar një kallëzim pranë Agjensisë së Mbikqyrjes Policore si dhe Prokurorisë pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm, Tiranë, KShH i bën thirrje institucioneve përgjegjëse ta hetojnë këtë rast me përparësi dhe seriozitet, me qëllim zbardhjen e plotë të ngjarjes dhe parandalimin e situatave të ngjashme në të ardhmen”, theksohet në deklaratë.

Në 17.04.2025, shtetasit O.Z dhe E.G, banues në Tiranë, prindër të të miturit 14 vjeçar J.G njoftuan Komitetin Shqiptar të Helsinkit (KShH) se më datë 12.04.2025 pranë zonës së Kodrës së Liqenit Tiranë, djali i tyre J.G ishte ndaluar nga punonjësit e Policisë të Komisariatit Nr. 1, Tiranë për shkak se ishte kapur duke hedhur kapsolla. Në ankesën e tyre ata pretendonin se ndaj djalit të tyre punonjësit e policisë kishin ushtruar dhunë fizike dhe psikologjike.

Për verifikimin e kësaj ankese, më datë 22.04.2025, dy vëzhgues të KShH-së shkuan në Komisariatin Nr. 1. Gjatë këtij verifikimi rezultoi se:

Sipas dokumentacionit të kqyrur, i mituri J.G, i datëlindjes 09.11.2010, në datë 12.04.2025, ora 18:40 ishte shoqëruar në Komisariatin e Policisë Nr.1. Shkaku i shoqërimit ishte dyshimi për prishje të qetësisë publike dhe hedhje të lëndëve piroteknike. Në dokumentacion shënohej se pas shoqërimit ishin njoftuar prindërit e tij.

Në Raportin e Shoqërimit shënohej se i mituri kishte një hematomë në krahun e syrit të djathtë. Në dokumentacionin e kqyrur nuk rezulton të jetë vizituar nga mjeku. Fakti i mësipërm u mohua nga punonjësit e policisë. Megjithëse në raportin e përmendur më lart ishte shënuar hematoma, nuk rezultoi që i mituri të ishte vizituar nga mjeku i Komisariatit, në kundërshtim me parashikimet e Kreut IV, të Procedurës Standarde “Trajtimi dhe sigurimi i personave të arrestuar/ndaluar në ambientet e Policisë së Shtetit, evidentimi dhe zgjidhja e kërkesë/ankesave të tyre”.

Me kërkesën e prindërve që shkuan në Komisariat menjëherë mbas njoftimit, u njoftua urgjenca e Spitalit të Traumës. Në regjistrin përkatës ishte shënuar fakti i mësipërm. I mituri u shoqërua në Spitalin e Traumës, në datë 12.04.2025, ora 20:00. Sipas epikrizës përcjellëse mjekësore që i është dërguar KShH-së nga prindërit e të miturit diagnoza është: Contuzion capitis, goditje me grushta. Të ndiqet nga mjeku i familjes për pushim dhe rikontroll sipas sistemit të referimit.

In the case mentioned above at Police Station No. 1, the minor JG was not provided with the necessary medical and psychological assistance, thus acting in violation of Article 34, point 1, letter c and point 1 of Article 35 of the Code of Criminal Procedure, as well as Articles 10, 14, 18 of the Code of Criminal Justice for Juveniles, which deals with the principle of the best interest of the child, the assistance of a psychologist and the use of alternative measures of avoidance. While the parents of the minor citizen, on 13.04.2025, have filed a report with the Police Supervision Agency and the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, AHC calls on the responsible institutions to investigate this case with priority and seriousness, in order to fully clarify the incident and prevent similar situations in the future.
